Court docs: Muncie man kicked, shoved police officers

MUNCIE, Ind. — One officer was shoved and two other cops were kicked while responding to a domestic disturbance in Muncie over the weekend.

According to an affidavit for probable cause released on Monday, officers were dispatched to a residence in the 3200 block of East Tanner Drive on Saturday after receiving a report from a woman who claimed a man was destroying her apartment.

When police arrived at the scene, they found the woman near a vehicle outside the apartment. She told police there was a man inside her apartment banging things around and punching walls.

According to court documents, police heard commotion inside the apartment while they spoke with the woman. Police then approached the residence and knocked on the door.

Law enforcement reported that 24-year-old Jaseland Falconbury answered the door. When officers asked him what was going on inside the residence, he said "nothing."

When police confronted Falconbury about the ruckus coming from the apartment, he told officers he would allow them to enter the residence and inspect it for damage. Court records indicate Falconbury outstretched his hand and gestured officers inside.

Police refused to walk into the unit in a way that would allow Falconbury to get behind them. Falconbury insisted police lead him inside and get in front of him.

Officers told Falconbury they weren't going to allow him to walk behind them. According to court documents, Falconbury then tried to slam the apartment's door on the police.

One officer stuck his foot in the residence's threshold to prevent Falconbury from shutting the door. Falconbury then shoved the officer to try to shut the door.

Police records show the officers then ordered Falconbury to get on the ground. After officers got him on the ground, Falconbury refused to comply with further commands, telling police they would have to carry him to a patrol vehicle.

When officers attempted to lift Falconbury to take him to a patrol car, he began kicking with both his legs. Falconbury ended up kicking two officers, per court documents.

Police later transported Faclonbury to IU Ball Memorial Hospital. When Falconbury arrived at the hospital, he said he wanted shoot up all the officers' houses.

Medics ultimately deemed Falconbury fit for jail. He was then transported to the Delaware County Jail.

Falconbury has been preliminarily charged with three counts of battery against a public safety official, one count of intimidation and one count of resisting law enforcement.

Battery against a public safety official and intimidation are Level 6 Felonies in Indiana. The maximum penalty for a Level 6 Felony in the Hoosier State is a 2.5-year prison sentence and a fine of up to $10,000.
