CARROLL COUNTY, Ind. -- Carroll County Special Judge Fran Gull will have a Richard Allen-related hearing beginning late next month.
According to court documents filed in Carroll County Circuit Court on Friday, a number of motions in relation to Allen's legal case are expected to be heard over the course of three days. The hearing will be from July 30 to Aug. 1 and start at 10 a.m. each day in the Carroll County Circuit Court.
Allen is accused of killing 13-year-old Abby Williams and 14-year-old Libby German near the Monon High Bridge in Delphi in February 2017. Since he was arrested in October 2022, there has been a number of back and forth legal exchanges and claims, as well as changes in dates, between Allen's attorneys and the state.
The three days of hearings are expected to cover various motions filed over the past few months between the prosecution and the defense. This includes evidence disputes, including a request by Allen's attorneys to dismiss ballistics evidence as well as claims surrounding Allen's status in jail.
In April, Allen's attorneys claimed that Allen was not read his Miranda Rights before his interview in October 2022. The attorneys also claimed of other "highly unusual" police behavior toward Allen, including missing portions of footage from the interview and keeping Allen in a small, windowless interrogation room for more than two hours before he was allowed to leave.
Allen's case is expected to go to trial in October, according to previous reports. This comes after Allen's case has been pushed back a number of time. As of Friday, Allen's scheduled trial dates are from Oct. 14 through Nov. 15 in Carroll County.
