Driver accused of hitting, killing Indy cyclist in 2021 now facing charges

INDIANAPOLIS — A driver has been accused of hitting and killing a bicyclist and fleeing the scene immediately after on Oct. 23, 2021. Per court records filed on Friday, he now faces charges.

According to the Marion County Sheriff's Office, an officer was traveling south in the 2600 block of South Harding Street around 11:40 p.m. when he noticed a person down in the middle of the road.

Upon radioing for assistance and further investigation from the Indianapolis Metropolitan Police Department, officers discovered that a man named Dustin Craig had been riding his bicycle in the area when a vehicle struck him from behind and threw him into the southbound lanes. Police said Craig was then struck by a vehicle traveling south on South Harding Street. He was pronounced dead on-scene by paramedics.

Neither vehicle that struck Craig stopped to provide information or help, the IMPD reported.

With evidence from the crash site, officers then determined the vehicle to be a green Saturn Vue that had allegedly had been stolen. Police were able to track the car down to its owners, who explained to them that they had lent it to now-53-year-old Bobby Foster. Allegedly, Foster had borrowed the vehicle before, but this time refused to give it back without further explanation.

Foster initially denied being involved in a crash. However, in a text conversation, he told a friend of the owners that the Saturn was "f***** up". The friend then asked how he knew the condition of the vehicle if he was not with it, presuming Foster had already returned it to its rightful owners. Per IMPD, Foster did not respond to that text.

IMPD also added that one of Craig's family members found Foster on social media. This led to a conversation about the incident, including questions about why Foster refused to stop his vehicle and was unable to see Craig on his bike.

During the conversation, Foster claimed it was dark and rainy, and "... when the crash happened, he freaked out and was in shock." Foster also admitted to a side mirror being left at the crash scene. He reportedly then told the family member he was going to turn himself in, asking forgiveness from both the family and God.

In December 2021, a detective from IMPD met with a friend of the Saturn's original owners — the very same friend Foster talked to about the vehicle being messed up. According to the friend, Foster admitted he drove the vehicle at about 70 mph and was the one who caused the crash. He was reportedly the only one in the vehicle.

Police ran a check of Bobby Foster through the Indiana BMV system. They found that he only has a regular ID card — not a valid driver's license.

The driver who initially hit Craig and sent him flying to the middle of the road has not yet been identified.

It is unclear why charges were not filed until nearly two years after the accident occurred. Stay tuned for more updates.
