MUNCIE, Ind. -- A Muncie man was arrested early Wednesday morning after a reported argument between neighbors about a car's headlights led to the man pointing a firearm at the person he was arguing with.
According to court documents filed on Wednesday in Delaware County, 50-year-old Kevin York was charged with one count of intimidation with a deadly weapon, a Level 5 felony, and one count of pointing a firearm, a Level 6 felony.
At around 2:30 a.m. on Wednesday, officers were dispatched to a home in southwest Muncie in reference to a man with a gun. The caller reportedly told officers that her neighbor, later identified as York, reportedly pointed a gun at her grandson.
When officers arrived, the caller told officers that York's vehicle was parked behind her apartment and his headlights were shining in the apartment. The grandson, according to the documents, "yelled upstairs to York asking why his lights were still on."
"(The grandson) stated York came out with a 'black 9mm handgun,' pointed it at him and stated 'I'll blow your s--- off,'" the documents read. "(The grandson) stated he then went back into the apartment. (The grandson) stated he felt fearful for his life when York pointed the gun at him."
In an interview with police, York said his girlfriend reportedly forgot to turn the headlights off on the vehicle when she came home from the gas station, stating that the grandson came out and began yelling about the light.
The documents said that York "changed his story" multiple times, first stating that he minded his own business, but eventually stating that he did have a verbal altercation with the grandson.
York told police he did own a black Taurus G2C 9mm handgun, which police found in York's bedroom. The documents said that York was taken to the Delaware County Jail and has since been released.
