CARROLL COUNTY, Ind. -- A former co-worker of Defense Attorney Andrew Baldwin, who is currently representing Delphi murder suspect Richard Allen in a highly anticipated jury trial, has had a misdemeanor charge dropped that was related to capturing and distributing sensitive crime scene evidence.
Mitchell Westerman of Westfield was charged in November of last year with one count of conversion - a Class A misdemeanor - after admitting in a sworn statement to local police that he was the person responsible for a leak of evidence related to the Delphi double murders.
Johnson County Prosecutor Lance Hamner said the case was overseen by Special Prosecutor Lindsey Holden-Key, who is based out of Bartholomew County. Westerman was charged with a misdemeanor in the case and had his case "diverted," meaning it would be dismissed by the special prosecutor when certain conditions were met.
Court documents obtained by FOX59/CBS4 said Westerfield had "successfully completed the terms of the Pretrial Diversion Program and that all fees have been paid."
FOX59/CBS4 has reached out to the special prosecutor to determine what the terms of Westerman's diversion agreement entailed.
According to previous reports, law enforcement first began investigating Westerfield on Oct. 5, 2023, when they were informed of a potential evidence leak regarding the investigation into the murders of Abby Williams and Libby German in February 2017.
This evidence leak, which contained photos taken from the original crime scene, had been distributed online and went on to cause several headaches for Allen's defense team as Judge Fran Gull removed Baldwin and Brad Rozzi from the case before they were later reinstated.
Previous reports indicate that Westerman reached out to Baldwin and admitted that he was the person responsible for the leak.
Westerman went on to admit that he found photographs of crime scene evidence spread out on a conference table at Baldwin's law firm and used his phone to take photographs.
Court documents showed that Westerman was a previous employee at the law firm and that he and Baldwin maintained their friendship for several years after that.
Although Westerman was not an employee, court documents stated that he said he would regularly pay a visit to the law firm to speak with Baldwin.
He also admitted at the time to sharing these same photos with a man based in Fishers. This individual passed the evidence leak to another man from Texas who then forwarded the photos to YouTubers and podcast hosts.
Westerman admitted that Baldwin did not permit him to take the photos and that Baldwin was not present when he took the photos.
The Delphi murders trial has wrapped up day six featuring testimony from Steve Mullin, an investigator with the prosecutor's office and former police chief in Delphi. Another highlight involved a DNR interview from 2017 that put Richard Allen on the radar of law enforcement more than five years later.
