GREENWOOD, Ind. — A Greenwood man reportedly ruined a couple's breakfast by arriving uninvited into their home with a baseball bat and starting a brawl.
Justin B. Wheat, 42, is charged with battery with a deadly weapon, a Level 5 felony. He also faces Level 6 felony charges of residential entry, intimidation and battery.
According to court documents, police were called out to a Greenwood home on Sunday on report of an assault. The victims told police they were sitting down to breakfast when the door opened and Wheat walked into their home with a baseball bat.
The Johnson County Prosecutor's Office said that Wheat and the victims know each other, though their exact relationship wasn't disclosed. Court records show that Wheat and one of the victims share a child together, according to paternity hearings.
The victims told Greenwood police officers that Wheat attempted to attack the male victim with the baseball bat; it turned into a scuffle between the two men as they fought over the weapon. During the struggle, Wheat is accused of elbowing the male victim and bloodying his face.
The victims were able to subdue Wheat until officers arrived on scene. Wheat is accused of threatening the intervening officers with statements such as, "I'll kill you," hurled at the Greenwood police officers, court documents detail.
Police reported a strong odor of an alcoholic beverage coming off Wheat at the time of his arrest.
The victims told police that Wheat was a former baseball player.
Court records show the female victim and her son had an existing protective order against Wheat. Wheat was also formally trespassed from the female's home on Saturday by a sheriff's deputy — one day before he allegedly returned with a baseball bat in hand.
If convicted, Wheat faces up to six years in prison on a Level 5 felony.
